Public offer

1. Who agrees to what

This is a public offer to enter into an agreement (articles 633 and 641 of the Civil Code of Ukraine). It is made by the sole proprietor (ФОП) whose details are in section 11 (the "Seller").

The Buyer is any person with full legal capacity who pays for access to a premium pack (the "Buyer"). Payment means full and unconditional acceptance of this offer (article 642 of the Civil Code); the agreement is made at the moment of payment.

Kolo is a question game for friends that runs in the browser on this site (under /app). You can play without signing up or creating an account.

2. Terms used

• Premium pack: a set of questions in Kolo marked with a lock, which costs money to open.
• "All premium packs": access to every premium pack in Kolo now and every one added while Kolo runs.
• Unlock code: a code like KOLO-XXXX-XXXX-XXXX that opens the packs you bought.
• Device: a browser on a phone, tablet or computer where the code has been entered.
• Host: the player who created the room, or who was made host during the game.

3. What the agreement covers

The Seller grants the Buyer a non-exclusive right to use the chosen premium pack (or all premium packs) in Kolo for personal, non-commercial use, and the Buyer pays for that access.

Everything that's free in Kolo today (packs, modes, features) stays free and isn't part of this agreement. Guests in a room never buy anything: packs the host has opened are played by the whole table.

4. Price and payment

The price is shown in hryvnias (UAH) on the pack screen before payment. As of this version:

• one premium pack: [FILL: 99] ₴;
• "All premium packs": [FILL: 149] ₴.

The Seller pays the single tax and is not registered for VAT [FILL: confirm with the accountant]. Price changes don't affect orders already paid. Cards in other currencies are charged in UAH and converted by the card issuer.

You pay by card (or Apple Pay / Google Pay where available) on the WayForPay payment page. WayForPay processes the card details; the Seller doesn't receive or store them.

An electronic fiscal receipt is issued by a software cash register (ПРРО) at the moment of payment and sent to the email address given on the payment page.

5. How access is provided

As soon as the payment is confirmed, Kolo shows the unlock code and opens the packs on the device you bought on. Access is provided electronically only; there's no physical delivery.

One code works on up to 5 devices. To open the packs on another device, enter the code under "Restore purchases".

The code is shown once. Keep it. If you lose it, write to the Seller with the order reference from the WayForPay receipt, and you'll get the code again.

6. Withdrawal and refunds

Before paying, the Buyer confirms that they want access right away and understand that they lose the right to withdraw from the agreement within 14 days once the pack is opened. This is the exception that article 13 of the Law of Ukraine "On Consumer Rights Protection" makes for digital content supplied electronically with the consumer's consent.

Regardless, the Seller gives refunds voluntarily in the cases listed on the Refunds page.

7. Rights and obligations

The Buyer does not resell the code, publish it openly, or copy questions from premium packs in bulk (for example to websites or social media). Sharing the code with people you play with is fine, within the 5-device limit.

If a code is published openly or used against this agreement, the Seller may revoke it. The Seller will issue a new code, on request, to the Buyer who originally bought it.

The Seller keeps Kolo running but doesn't guarantee it will work without interruption: maintenance and outages can happen.

8. Liability

The Seller's liability under this agreement is limited to the amount the Buyer paid under it.

Neither party is liable for failing to perform because of force majeure, including martial law, hostilities, or long power or network outages.

9. Rights to the content

Kolo's questions, pack names and design belong to the Seller. The agreement gives the Buyer no rights to them other than the right to play.

10. Other terms

How Kolo handles data is described in the Privacy policy.

This offer is in effect from its publication on this page until it is withdrawn. A new version is published here with a new date; an order is governed by the version in effect when it was paid.

The parties try to settle disputes by writing to each other first. Failing that, disputes are governed by the law of Ukraine.

This English page is a translation. If it differs from the Ukrainian version, the Ukrainian version prevails.
